Welcome to Sinavy. The terms "we", "us" and "our" refer to Sinavy, a French SASU with its registered office at 92 Rue Edouard Plachez, 62220 Carvin, France (SIRET 964 767 904 00013). We operate this store and website, including all related information, content, features, tools, products and services (the "Services").

These Terms of Service ("Terms"), together with the policies referred to in them, set out your rights and responsibilities when you use the Services. By visiting, using or buying from the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

Nothing in these Terms limits or excludes any rights you have under the consumer laws of the country where you live, including the Australian Consumer Law and the consumer protection laws of the United Kingdom.

SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least the age of majority where you live. You agree to provide accurate, current and complete information when you place an order, and to keep it up to date. You are responsible for keeping your account details secure and for all activity under your account.

SECTION 2 – OUR PRODUCTS
Our products are cosmetic products for external use only. They are not medicines or medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Results vary from person to person and depend on regular use as directed. Any results described on our website are not guaranteed for every customer.

Before first use, please read the full ingredient list on the product packaging, especially if you have allergies (body oils may contain nut oils). Patch test on a small area 24 hours before first use. Do not apply to broken, irritated or damaged skin. Stop using the product if irritation occurs and seek advice from a doctor or pharmacist if needed.

We make every effort to display our products accurately. Colours and appearance may vary slightly depending on your screen. We may change product descriptions, limit quantities or discontinue products at any time.

SECTION 3 – ORDERS
When you place an order, you are making an offer to buy. Your order is accepted once we send you an order confirmation email. We may refuse or cancel an order, for example if a product is unavailable, if there is an obvious pricing error, or if we suspect fraud. If we cancel an order after payment, we will refund you in full.

Our products are sold for personal use only, not for resale.

SECTION 4 – PRICES AND PAYMENT
Prices are shown in the currency of your market (for example AUD for Australia and GBP for the United Kingdom) and include any taxes we are required to collect at checkout, where applicable. The price you pay is the price shown at the time you place your order.

Promotions and discounts are subject to their own conditions and may change or end without notice, but any promotion displayed when you order will be honoured for that order.

Payment is taken at checkout by card, PayPal, Apple Pay, Google Pay or any other method shown. You confirm that you are authorised to use the payment method you provide.

SECTION 5 – SHIPPING AND DELIVERY
Shipping is free and tracked to the countries we deliver to. The estimated delivery date is shown at checkout and in our Shipping Policy. Delivery times are estimates and may be affected by carriers, customs or events outside our control. If your order is significantly delayed or does not arrive, please contact us and we will help resolve it.

You are responsible for entering a correct and complete delivery address.

SECTION 6 – RETURNS, REFUNDS AND OUR 90-DAY GUARANTEE
Your purchases are covered by our 90-day money-back guarantee and by our Refund Policy, which form part of these Terms. Our guarantee is in addition to your statutory rights and does not affect them.

SECTION 7 – REVIEWS AND FEEDBACK
If you submit a review, comment, photo or other feedback ("Feedback"), you confirm that it is genuine, reflects your own experience, and does not infringe anyone's rights. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display your Feedback to operate and promote the Services. We do not edit reviews in a misleading way and we do not pay for positive reviews. We may remove Feedback that is unlawful, offensive or misleading.

SECTION 8 – INTELLECTUAL PROPERTY
All content on the Services, including text, images, logos, designs and product names, belongs to Sinavy or its licensors and is protected by intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute or exploit any part of the Services without our prior written consent.

SECTION 9 – PROHIBITED USES
You may not use the Services: for any unlawful purpose; to infringe anyone's rights; to harass or harm others; to submit false or misleading information; to upload viruses or malicious code; to collect other users' personal data; or to scrape, copy or interfere with the Services using automated tools, bots or AI agents, unless they identify themselves and respect any restrictions we set. We may suspend or close your account if you breach these Terms.

SECTION 10 – THIRD-PARTY TOOLS AND LINKS
The Services may include tools or links provided by third parties. We do not control and are not responsible for third-party websites, products or services. Your use of them is subject to their own terms and policies.

SECTION 11 – RELATIONSHIP WITH SHOPIFY
Sinavy is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Sinavy. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Sinavy, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Sinavy.

SECTION 12 – PRIVACY
Personal information you submit through the Services is governed by our Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. SECTION 13 – ERRORS AND OMISSIONS
The Services may occasionally contain typographical errors, inaccuracies or omissions, including in product descriptions, prices, promotions or availability. We may correct them at any time. If an error affects an order you have already placed, we will contact you and you may cancel for a full refund.

SECTION 14 – LIABILITY
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or under the consumer guarantees that apply to you by law.

Subject to the above, and to the extent permitted by law, we are not liable for losses that were not reasonably foreseeable, or for losses caused by misuse of the products or failure to follow the directions for use.

SECTION 15 – TERMINATION
We may suspend or end your access to the Services if you seriously breach these Terms. Sections that by their nature should continue (such as intellectual property, liability and governing law) will survive termination.

SECTION 16 – GOVERNING LAW
These Terms are governed by French law. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in the courts of your country of residence. We will always try to resolve any dispute with you amicably first.

We may update these Terms from time to time. The version in force when you place an order applies to that order. The latest version is always available on this page.
